POSITION SUMMARY:

The General Counsel is responsible for managing the daily operations of Doctors Hospital at Renaissance (DHR) office (attorneys, legal assistants, and administrative assistant) and managing outside counsel; reports directly to DHR’s Chief Executive Office; will serve as principal liaison between DHR and its office of General Counsel with numerous other state and federal agencies.

POSITION EDUCATION/ QUALIFICATIONS­:

  • Juris Doctor (JD) degree from an accredited law school and a member in good standing, of the Texas State Bar (or ability to be admitted within one year of hire)
  • Computer skills required with knowledge of Microsoft Office suite.
  • Good written and verbal communication skills required.
  • Some evening or weekend work will be required
  • Bilingual – English/Spanish.

JOB KNOWLEDGE/EXPERIENCE­:

  • Ten (10) years of litigation experience or other related legal experience handling a variety of legal issues and providing legal advice to a diverse client base.
  • Experience must be related to areas of responsibilities and include progressively responsible administrative/management experience within a Acute Care Hospital
  • Skill in establishing a balanced perspective on mission effectiveness and business results is critical.
  • Knowledge of State, Federal, and JCAHO regulations.

Responsibilities:

POSITION RESPONSIBILITES:

  • Promotes the facility mission, vision and values by effectively communicating them to others. Considers mission, vision and values in developing services, standards and practices.
  • Other duties as assigned.
  • Negotiate and draft contracts and agreements including physician arrangements, and services and supplier agreements.
  • Advise clients about the impact of recent regulatory and legislative changes and guidance.
  • Maintain current knowledge of federal and state health care law, with a particular emphasis on Stark, Fraud and Abuse and Civil Monetary Penalty compliance.
  • Work on transactional matters, particularly physician acquisitions, including negotiating agreements, drafting documents, conducting due diligence and obtaining regulatory approvals.
  • Act as a consultant to medical staff regarding legal issues and concerns involving patients.
  • Participate in committees and assisting in the development of DHR policies and procedures that raise health law issues.
  • Support the corporate compliance program and providing legal advice related to compliance matters.
  • Make presentations both inside and outside DHR and conducting teaching sessions for medical and professional staffs and other employees regarding relevant legal issues.
  • Work directly with outside counsel on issues requiring specialized legal consultation and serves as liaison with outside counsel on referred legal matters.
  • Participate in the Attorney On-call rotation for medical-legal emergencies.
  • Perform other duties as assigned consistent with a lawyer with 8-12 years’ experience in health care law.

AGE SPECIFIC:

Employees must be able to demonstrate the knowledge and skills necessary to provide care appropriate to the age of the patients served in his/her assigned unit. The individual must demonstrate knowledge of principles of growth and development over the life span and possess the ability to assess data reflective of the patient’s status and interpret the appropriate information needed to identify each patient’s requirement relative to his or her age.

B. Working Conditions: The individual spends over 95% of his/her time in an air-conditioned environment with varying exposures to noise. There is protection from weather conditions but not necessarily from temperature changes. The position does have low exposure to malodorous, infectious body fluids from patients and some minimal exposure to noxious smells from cleansing agents.

C. Occupational Exposure: This position has minimal to no exposure to blood, body fluids, or tissues and is an OSHA Category III (although situations can be imagined or hypothesized under which anyone, anywhere, might encounter potential exposure to body fluids). Person who performs these duties are not called upon as part of their employment to perform or assist in emergency medical care or first aid or to be potentially exposed in some other way.
